To appeal an arbitrator’s denial, we will submit two copies of a petition for review along with a written explanation of why you are appealing within 30 days of the denial.

Within 35 days, we will need to file either a statement that talks about the facts about which you and the road construction company agree that were presented at the hearing or a hearing transcript. It is crucial you give us a call immediately after a denial of your claim. If you don’t file the appropriate documents in time and don’t get an extension, an arbitrator’s decision becomes the final decision.

At the appeal, three IWCC commissioners will hear arguments for why the denial was inappropriate. They will review all evidence used in the arbitration hearing as well as the arbitrator’s decision and any written arguments presented by you and the insurer.
