What is the National Labor Relations Board?

The NLRB is an independent federal agency that is charged with conducting elections to determine whether a group of employees should be represented by a union. The NLRB is also responsible for investigating allegations of unfair labor practices and implementing the appropriate judgments and remedies.

The NLRB is made up of a five-person board and a General Counsel, all of whom are appointed by the President of the United States with the approval of the U.S. Senate. NLRB board members are appointed to five year terms and the General Counsel is appointed to a four-year term.

The General Counsel acts as a prosecutor in hearings before administrative law judges. If either party appeals the decision of the administrative law judge, the NLRB board presides over appeal hearing.
